Rationality and reason in decision making – or a roll of the dice?

The Hon Robert French AC will speak on

‘Rationality and reason in administrative law – would a roll of the dice be just as good?’

The lecture, hosted by the Australian Academy of Law, will be given on Wednesday 29 November 2017 at 5.30pm in Perth.

Rationality and reasonableness in official decision-making have been the subject of much discussion, not least since the decision of the High Court of Australia in Minister for Immigration v Li (2013) 249 CLR 332; [2013] HCA 18.

The “lecture explores an approach to rationality and reasonableness in the context of judicial review and the question whether there is a role for randomised decision-making in cases of equally valued choices or intractable uncertainty”.

Mr French was the Chief Justice of the High Court of Australia from 2008 to 2017.

The venue is the Judges Conference Room, Level 8, Federal Court of Australia, Peter Durack Commonwealth Law Courts Building, 1 Victoria Avenue, Perth.
